Cartmell Shepherd Solicitors advise that the no-fault divorce is nearly here!

Award-winning Northern legal firm, Cartmell Shepherd have provided an update to the long-awaited change to the divorce laws.

Amy Fallows, Cartmells Associate Solicitor in their Family Law team is pleased to announce that the moment many separated couples have been waiting for is nearly here… the true ‘quickie divorce’.

Amy says, “A law should be passed by Parliament in the next few days which will allow couples to divorce if they wish. Currently one spouse has to cite unreasonable behaviour or adultery if they want to divorce straight away. Many instead opt to wait two years so that they can divorce based on 2 years separation with consent”.

Family lawyers have been campaigning for ‘no-fault’ divorce for a long time. The current system requires ‘mud-throwing’ to achieve a divorce. The process raises the temperature of the proceedings and can set the scene for a battle. The new law should enable spouses to divorce in a civilised way without having to point the finger.

All those couples who are waiting for two years to pass will now be able to fast-forward the process. It is often important to get matters concluded before moving on. The new law will enable couples to do just that.

The Cartmells family team has supported no-fault divorce for some time and welcome the legal development. If you would like to know more about finalising your divorce please do get in touch with the family law team by calling 01228 585716.

The team are continuing to offer telephone and video appointments during the Covid-19 crisis.
